Let me guess...you're a teenager or not much past it, right? That is life, I'm afraid. Do you have an attorney? If not, get the best one you can afford. Being present at the scene of a crime is enough to be arrested. You need legal help to keep you out of trouble if and when this goes to court.

If what you say is correct, then you should be able to establish a defence, as you were walking away from the scene and provided that you hadn't got involved at all in this criminal activity, then you were not part of the criminal conspiracy to smash the car. Sometimes the police on these occasions grab everyone in sight so that they can establish who are the true culprits. If the people who were smashing up the car are prepared to plead guilty (which seems rather inevitable) and you are able to stick to your story, then with any luck you may find yourself not brought to court at all at the end of their investigation or, if you are charged, have the charges dropped. There are occasions when the people committing the offence are even prepared to state that their companions were walking away from the scene, although this doesn't happen too often.

You dont say if you were charged with the offence.
I might be wrong, but I think it is because it is presumed beyond all reasonable doubt that you were involved in the incident because you were party to your friends who did smash it up, and so are deemed to have been involved as well, because you did nothing to stop your friends from commiting a crime i.e. criminal damage to someones personal property.
You should have run, instead of walked! Why did they smash it up?

why should the police assume because you were walking away you had nothing to do with it. which also means you were right there in the area as it was happening. that is guilt by association. not trying to stop it, but allowing it to happen. i suggest you find other friends , ones with better interests and higher goals.

you were charged because you were seen with the group who was doing the deed therefore by going with them to the scene you are guilty of the crime too.you were there and spotted not trying to stop it therefore you are as guilty as the rest. get better friends

that's how it is when you are too close to the scene of the crime.... if you are ever around someone who talks about doing stuff like that --- get away from them as quick as possible, don't wait until they are committing the actual crime....
