If someone is suing you they have to present you with a writ. If you're being called into court a writ will have to be placed into your hands in person by an officer of the court.

Additional info: Judgements on credit are not the result of law suits.

You would know if somebody is suing you because they would serve papers on you. This isn't something that people do in secret and then one day you find out you owe somebody money because they sued you.

you would get served with papers as soon as someone sued you. i would in a realestate office, i see it about 3 times a month.

The answers are partly correct, however many people end up with judgements on there credit and never were served anything.
