well it is classed as government fraud,,if paid directly into an account you could clam you just didnt register the amounts and spent it in grief,however if you phisically went and cashed a cheque it wont look good,,grief or no as it is premeditated theft.for fraud you can get a prison sentence but it is unlikely as it was for only 3 months,,maybe a fine,definately a criminal record and you may have to smash some rocks by the roadside for a few weeks,you could check local court records for similar recent cases and see what is happening legally in your area,,just hope they are not setting examples at this time.

they should be made to pay it back. maybe she needed it to survive. you gotta look at all sides if she did it just because then put here in jail.

It could be considered fraud, forgery, theft by deception, et cetera. It could include jail.
