My lawyer has repeateately ignored the facts in my court case. During my motions hearing, he did not bring up a specific topic even thou it was crucial to my case. When I asked him why he did not he stated it was late, everybody was tired so I decided not to. I ask him when was my next motions hearing scheduled. He said "that was your hearing, there will be no more hearings".
He also let the deadline for entering motions on some newly received evidence, which clearly shows eveidence tampering in several photos. This evidence would of taken the Judge from the road of convition to one of myself as a victom in a case of police coverup because they spent a lot of money on an individuals information who wanted out of jail and lied to authorities in order to get released. The police must of decided they did not want to be embarassed for letting a convicted felon use them, costing the County a lot of money, and embarassing themselves because of poor investigation. Really no investigation.

Ineffective assistance of council is grounds for a new trail, and appeal, however you can fire him in court and if you do it in a loud and obnicious way, you can even disqualify the judge! A cheap investment would be the Prisoner Prose self help litigation manual available in most law libraries

At your next hearing ask to address the court(the judge) and tell him you would like to fire your attorney because he is not defending you to the best of his ability and their are many conflict of interests between you and he. If your are being defended by legal aid or other agency, call them and advise them that you would like a new attorney appointed to you and your reasons. They must provide you,
with another legal representative if you are not satisfied with your current counsel. Also I would also file a complaint with the Lawyers Bar Association, further if your lawyer is a hired legal counsel i would address him personally and advise him that you intend on discharging him, and
will file a civil suit against him for misrepresentation and negligence in preparing your case.

A motions hearing is not the time or place to enter evidence. Your lawyer knows more about law than you do.

But if you want to fire him, then do it!

If you really feel that he misrepresented you, you can ask for a grievance form at the office of the courthouse clerk, and send it for review by the board. It may also be available in the state's website, judicial page.

He can't do anything against you for it, but may (and should) ask to be withdrawn from your case. At least you get the chance to have your concern reviewed by the board that certifies lawyers

You have the right to defend yourself. You can fire your attorney; or if he's a public defender, ask the judge to remove him so you can defend yourself. Then see how well you do.
