The landlord is charging the guy in the next apartment - same level, same view - $50.00 per month less than she is charging me. Can she do this?

Yes it's perfectly acceptable. The conditions of the second apartment may be different. There may be an alternate view, or one party may have a longer lease which has resulted in incremental increases which may be well below market value.

Rents are controlled by the housing market, and the property owner has an obligation to remain as competitive as possible to rent the vacant apartment. This can mean a difference of a few hundred dollars or maybe less on apartments with negligible differences.

It greatly depends on when and where you rent, and how desperate the property owner is in closing the vacancy.

There are also tax credit programs that allow lower/middle income families to rent apartments at subsidized rates, and rent control and stabilization laws that prevent an owner from subjecting their tenants to unreasonable rent increases.

But the short answer to your question is yes.

yes they can maybe the other person has been there a while and the rent was cheaper then when you moved in either way you excepted the apt at the current rent so be happy they can go up every year if they choose but only a certain % i know some landlords that use this method to get rid of tenants they don't like they raise the rent to a point where they will move then they don't have to go through the eviction process dont feel bad my rent just went up by $50.00 in october i dont like the fact but its not enough to make me move yet anyways

Certainly can. I charge different rents depending on the length of the lease and the economic outlook when the property is rented. I give an elderly person who takes really good care of the property a cheaper rent, cause he is a great tennant and helps me out by keeping an eye on the rest of the property for me. I had another tennat who was a complete *****, so when her lease came up, we took the rent up to full market value. She left thankfully.

WAS THE OTHER PERSON THERE BEFORE YOU ? SOME TIMES IF A RENTER GETS A TENANT THAT STAYS A LONG TIME AND PAYS RENT ON TIME AND DOSNT CAUSE TROUBLE THE RENTER WILL KEEP THERE RENT THE SAME PRICE WHILE OTHERS GO UP . sorry im not mad i just forgot my cap lock

I think it depends on the upgrades she has made to the apartment,otherwise she is scamming you.
