I just bought a new home and we had a lot of rain. I noticed a water stain on the ceiling in the bathroom. The warranty guy said that he will have the roofer come back to reseal the vents on the roof. (my house is not the only one that had this issue). They are sending out a sheetrock replacement person but when I asked about replacing the insulation that was wet he said the sheetrock person doesn't do that and they were not going to replace it. I told him that it needed to be replaced. I do NOT and I am sure there are others that don't want mold/mildew growing inside the walls. He proceeded to tell me that we don't have mildew in TX and that mold & mildew are not the same thing. I don't care about the difference between the two. I know neither one is good. I just want it replaced, you can tell that the insulation has been wet. I don't want problems in the future.

Texas does not have mold and mildew, don't make me laugh, its one of the worst states for that in the Nation- the largest Lawsuit in history on this issue took place there. lol Ask the Builder if he has heard of the 45 million dollar settlement for Mold ordered to be paid by Farmers Insurance company- because they refused to do a Thurough job or abatement.
Tell the Builder you don't give a dam who does it, just get it done. When the SR comes down, the insulation will come with it, so it has to be Replaced.

Yes they should replace it. They should replace the insulation before they put the sheet rock. The insulation is part of having a new home built. I don't know what part of the insulation isn't part of the new house. Being wet does need insulation replaced. You are talking a new house here, not a house that has been there forever.

It depends on what kind of insulation they used and what happens when the sheet rock guys do their thing. If you have fiberglass batts, it may not be a very big deal. The fiberglass will dry on it's own and the batts probably won't be disturbed too much with the sheet rock work. If you have blown in insulation, it probably needs to be replaced. Besides loosing insulation when they replace the sheet rock, it will probably have matted down some with the water exposure.

Talk to the guy's manager about this. Get advice from an independent surveyor about the problem. It would seem sensible to me to replace the insulation you speak of while they have the chance, rather than just leave it. Once they seal everything back up, it will not dry out properly, leading to more problems later on.

most home buyers do not know , but they have 2 years to report anything they find wrong. call the contractor who built it. and he will have the insulator back out there. the one who did the roof is responsible for anything that was damaged.

The problem lies in that you took ownership of the house from how I understand it, as is, they were really under no obligation to fix anything from when you signed the papers or took the keys, unless they had a contract saying they would provide such things after you took ownership
