Go to the court house and look it up...My husbands ex has his last name still, the ex can keep it if they wish....

Well if your getting married, you should be open enough with each other to be able to talk about it, Just ask him, if he loves you, which I'm sure he does, He'll tell you the truth. It is not a requirement for the woman to give up her ex-husbands last name when they get a divorce.

Why are you getting married?? be sure of him only then go for it otherwise you have no money and along with that you do not want to get into a deeper hole. It is no big deal for a woman to have the last name of a former husband

You shouldn't be getting married or even thinking of marriage if you don't even know if he is divorced or not.
You can discuss this with her. You can also go down to the court house where it would of been filed and see if any papers were filed.
If you can't ask him and trust his words, obviously marriage should not even be in your mind with this guy.

The only way you are going to know for sure -- go to your legal aid office and ask for help. It's not unusual for people to divorce and for the woman to keep the name, as sometimes it's a headache to change your i.d.
If you don't trust your man, don't marry him.
