Last Paycheck

Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment. If the regular payday for the last pay period an employee worked has passed and the employee has not been paid, contact the Department of Labor's Wage and Hour Division or the state labor department.

The Department also has mechanisms in place for the recovery of back wages.

depending of the state. I would check with your labor board. Typically they like to hand you the last check as the boot is helping you out the door. If you know what I mean. If they hold on to your check past the next pay period, then I would on the phone to the labor board discussing this matter. They would have to pay heavy fines and I doubt that they would want to spend more money in court than that of what your check would be.

legally if there is no objection from all the departments of the company and the employee is quiting on his own then the employer should immidietly clear the last pay check with all the benefits discussed at the time of joining.
