A county in MS has a jail without a doctor or nurse to give the inmates there medications. The sheriff has asked the supervisors for a doctor or RN to administer there medication but was refused. Is this against the law? And if so where can I find this law?

Yes, it's against the law. Even inmates have basic human rights. They receive health care and the state is responsible if they are neglected. I am unsure of the best location to research this matter. I would think the District Attorney's office would be the first place to call and check.

As long as the medications for the inmates are prescribed by a licensed physician, filled by a licensed pharmicist, and the inmates take them as written on the med. packages, they do not need a doctor or a nurse to give it to them. HOWEVER, common sense would indicate that it would be in the jail's best interests to have someone there to monitor the medications and useages with some medical training. The first time they get a lawsuit for an inmate taking the wrong medications, they will change their mind.

I doubt you will find a specifically written law concerning this, as I am not familiar with any laws specifically dealing with this, but it may be covered in the jail policy and procedures manual, but it is something to wonder aobut.

They are not required to have medical staff on the facility. They are required to get medical staff or take the inmate to a medical facility if the inmate is in need of medical care. Perhaps you can find more information at this site.

as a former deputy yes jailers and deputys can dispense meds to inmates as long as it is presribed by a doctor.we wpold get the meds in blister packs and go around and give them to inmates who would then take themeds or refuse them and we checked to make sure that they took them and noted the time and date.having a doctor or rn on duty 24/7 would be cost prohibitive to even the largest jails.

probably not against the law. you need to check the inmates rights laws in Mississippi to see if they can do that. plus the town maybe so small that they cannot afford anything. i am sure they some health care provision made.
