I was interested in buying ranch and I recieved the contract by FedEx. So I went ahead and sent the earnest money check BUT had sent the contract. So I called the realter telling him that I sent the check and have not gotten a response for 5 days already. Is there any way I can get back my money even though I have not sent the contract and the realter won't return my calls or messages?

The earnest money in and of itself does not constitute a contract, nor does it signify acceptance of a contract. To be valid, a contract must be accepted and that acceptance conveyed to the seller.

I would seriously consider contacting the relevant state's Real Estate Board and lodging a complaint with them as well as with the principal broker of the agency you have been dealing with.

Call the agency he works for and demand an answer or your money back. He could lose his license and the agency could get into a whole lot of trouble over this. Ask the bank if the check was cashed, also. If not, stop payment on it.

Contact the Department of Real Estate in your neck of the woods. Make sure you include the name of your person, and there company. In CA you go to the DRE website and look up a licensed Realtor by name and location and get their license number and report it. Good Luck

Contact the Real Estate Broker about his agent not responding to your calls or messages.

if you know the name of the real estate company you can call management
also put a stop payment on the cheque if it hasn't been cashed and if you call your bank I think you can refuse payment by payor on the cheque even if it was cashed
( and the cheque payment should be able to be reversed )
