We live in Arkansas, my son is 11 right now but will be 12 on Dec. 16th of 2006 and we would like to know what age and what we would have to do for him to live with me instead of his mother. Thank you

Usually when your son is 12 he can decide. However, consult an attorney so nobody tries to accuse you of kidnapping.

If your son is not in a good situation with his mom, please do what you can to get custody. Don't let the initial child custody decree disuade you.

I wish my dad tried harder to get custody. The court automatically gave custody to my mom when I was 10 years old, even though she had no job and schizophrenia. The court would not give custody to my dad even though he was sane and had a very good job. The child support my dad sent to my mom didn't matter, because my mom can't manage money. We moved every six months and lived in bad neighborhoods. My childhood would've been much more stable with my dad. Don't give up.

I think in most states the age of 12 is when a child can go back to the courts to let the judge know which parent he wishes to live with. So good luck =) Hope all works out for you and your son...

I would talk to your attorney, or if you don't have one, get one knowledgeable in the practice of family law. If your son wants to live with you instead of his mother, you can have him petition in court, asking to live with you. A judge will ask your son questions to see if he completely understands why he is in court, and why he wants to live with you instead of his mother. Usually, a judge will grant the petition on the basis of a 12 year old has the mental capacity to understand and have common sense to determine what he wants. I think you both have a good shot at this.

You would need to discuss this with his mother. I think legally he is at an age where he can make up his own mind. Go soft on her this won't be easy for her to hear. Make a list of pros and cons and take it from there. What is best for your son is what really matters. Good luck n God Bless.

well talk to your lawyer that all you guys can do. or you can take her to court and get your son. that only if she a bad mom. well i hope this help and good luck.
