I have not seen my x for 12 years. He stays on the fun because he owes child support. I have built a good life for myself including buying a house and so forth and don't want to take a chance of him showing up one day and trying to take part of it. He hasn't paid anything he was suppose to. I have done it all. I don't know where he is.

Yes if the divorce is uncontested. That means if you and your spouse totally agree on all the terms and conditions and are both willing to sign. If there are children involved you both have to agree on the support, visitation, etc. Everything has to be agreed upon. If there are any discrepancies then you will need a lawyer.

I live in VA also, and I know a couple of people who split amicably enough, and they both filed and got divorced without lawyers. However, in your case since your husband is MIA and he'd have to be served with papers by publication and there are some other issues to work out, you will probably need one. It probably won't cost much, because usually the ugly divorces where no one can agree on anything are the ones that rack up the fees! I know a few people who have had those too!

Look it up on the internet..
Search for "Divorce Virginia" and see what comes up..
I know in many states a no fault / uncontested divorce can be filed
without a lawyer...Texas for example, does not require a lawyer for a no fault / incompatibality divorce..

It's best to get yourself a lawyer so that he/she can become involved in the case and get you the unpaid child support that you deserve.
However, you can go to a small claims divorce court will you can represent yourself without an attorney.

The only time that works out and ends up OK if both parties fully and completely agree on everything, and thats rare.
