I fired an employee of mine 2 months ago and she still hasn't came back to collect her personal belongings, i.e.: radio, family pictures, etc. How long do I have to hold onto it before I throw it away? I have contacted her several times and she keeps saying she will be in, but never shows.

Don't throw her stuff away. Call your local state employment office and see if there are any laws governing disposal of a former employees property. Your best bet, is to mail all the items to her last address, Certified Return Recept mail. Include an item inventory with the shipment and have a least two people present when all items are collected and packaged. She could be waiting for you to throw things away so you end up in Court.

Call her and ask her to pick them up, again and give her a specific time limit to do so. If she lives nearby 7 days should be sufficient time for her to recover her things but warn her your going to dispose of the items after that time.

call her about 10 times, once a week, for the next 10 weeks. if she doesn't come in after 10 weeks, then you can throw it away.
