I had a Bush v. Gore hypothetical due a few semesters ago in the exact same class. I'll make it short and sweet. They claimed that the recounts in Florida violated the equal protection clause because under the law there is no one clear and concise way to recount the ballots. District to district they were being counted differently. The electoral college was set to vote in just a few days, so they ceased all recounts and let the vote pass into the electoral college. Because of this, Bush took Florida, as the recounts had been stopped early, and therefore took the election. The case breif itself is pages upon pages, and terribly confusing, but after a few read throughs you get the picture of it. It was one of the most stressful cases I had to do. Good luck

The main issue was whether a court would interfere in an election process in a way that would result in certain voting districts being benefitted by recount procedures while other districts would not.

Gore's team would not allow thousands of millitary absantee votes to be counted, because they were a day or two late arriving from overseas. And yes, 80+% of the millitary votes republican.

I'm not even going to give you my opinion, except to tell you that most people who respond to this haven't read them and haven't a clue what they really say, and that I hope that's really what your paper is about.
