Help! I am being sued for custody of my child b/c I give him his Metadate. My ex thinks that he would be fine without it, but my ex hasn't seen him without meds. He does so much better with meds, he can play sports, focus in class, gets MUCH better grades, and is manageable at home. But, my ex is a naturalist who is avidly against pharmaceuticals, and now he wants to take me to court and take my child away.
Can anyone help me prove to him that this drug is safe and necessary? Has anyone else gone through this? I can't put my child through another move of households. :(

How long have you had physical custody? If it has been a while and your child is under a medical doctors care, it is truly doubtful that any judge would remove a child from a home where he is doing fine and place him with a part time parent.

Of course, this will cost both of you thousands of dollars in legal fees and medical experts, your child will end up hating you both when he grows up and realizes he has been a pawn in both of your hatred against each other.

I feel for you, really I do. My ex played the stupid games for the 11 years from our split up, until our son turned 18. I tried to take the high road, didn't bad mouth the s.o.b., refused to get drawn into the fight and guess what, it was SO HARD. But my son now, has a relationship, but virtually no respect for his father, but has told his friends that I am his best friend and he is 23.

You can't control what your ex does, but if he goes to a lawyer, the 10K retainer his lawyer will ask for will wake him up really fast.

Do what the doctor tells you to do, and let your ex be an *ss, he will anyway. And try not to worry about it until the day the legal papers are served on you.

Metadate is just Ritalin. Your ex may have read about the controversy that these meds are over prescribed and there is a "theory" that we are setting up these young brains to crave other drugs as the kids get older. It sounds like your son is benefiting from the med and your ex maybe needs to take him for a week when he's off Metadate and see if his opinion changes. Right now the whole load is falling on you.

While I am not big on pharmaceuticals, but I think the court will be on your side. There are children who have been taken away from their parents for them not giving the children meds. Talk to your child's Dr. and do real meds research (not here). You may even go to a library for help. I live with a librarian and their masters degrees are for doing research not just handing out books, i.e. they can really help you.

My friend went through this with a different kind of meds. The dad didn't bother to give meds during his visitation weekends. The judge sided with the mom because it was a prescription. You don't have to justify the effects of the drug. Just show the scrip.

If the you're no longer the organic and organic father you could't sue for custody of the baby. you will possibly be waiting to sue for baby help reimbursement. The courts might question you however as to why you probably did no longer take a paternity try.

Talk to your doctor.
You two are really going to screw up this kids life if you cannot pull it together.
Get a referral to a mediator or counselor who can help you sort this out.
