I sold a new laptop on ebay. Buyer declined to have the item insured. When he received it he claims that the screen was broken. I dont know if he broke it or USPS broke it. I told buyer that I couldn’t refund his money since he declined to have the item insured. He opened a Paypal Dispute case.

It is now day 38. Paypal has decided that I have to refund his money. However, Paypal has not contacted me at all during their investigation. They have not returned my calls or bothered to gather facts from my side.

I have a negative balance on my account. My credit card on file expired, so I'm ok there.

I didnt scam anyone, I have a good track record with eBay and Paypal. If anything the buyer may be committing fraud, but it seems like paypal already made their decision.

What can I do? Any help would be very much appreciate. Thank You.

One of the realities of sellers using credit cards to accept payment is that sellers are often the short end of the stick. Whether you are using Paypal or your own merchant account -- they ALWAYS side with the buyer, whether the buyer is wrong or not.

Worst, they will not side with you nor even take your side of the issue. Even if you have proof of delivery signed by the buyer, or in your case, proof that the buyer refused insurance, the seller will always be forced to pay back the item (and even charged with a chargeback fee).

Whether you scammed anyone or not is not the issue. That is just the reality of selling online. Merchant account intermediaries such as Paypal is not interested in what the sellers have to say (sad but true).

Your choice is to make sure that you don't use Paypal again, nor the accounts associated with your Paypal account. Find another merchant account provider or a credit card processing company. OR pony up the refund amount through Paypal and get this over and done with

I believe ebay and Paypal are now connected - my suggestion if you cant get anywhere with paypal is to contact ebay on their link to talk directly with someone (or if your in the US I believe you can ring them?? Im unsure about that one as Im in Australia) Im sorry this has happened to you.. I was always worried about things like that happening so I put a limit of $100 on my ebay items - meaning if I believe an item (such as your laptop) would sell for over $100 I wouldnt have Paypal as a payment option - I love Paypal as a buyer it has been wonderfully handy but I know the perils of being a seller - a buyer has 6 months that they can do a charge back on their credit card - if you think about it any dishonest person could wait till close to 6 months and say HEY I NEED SOME MONEY!! and do the charge back and there is not a lot of come back for you.

well i need this help 2 ,cuz i design a website for this kid and he paid me w/ paypal from his grandmother creditcard and she said it was stolen..it's been 3 yrs and i still need to pay paypal back..

your first mistake was using paypal.
the best thing you can do is contact a lawyer.
