Let's say the underage person attempts to buy alcohol, is asked for identification, then is identified as being underage (no attempts to use illegal ID). Has the underage person committed a crime in simply attempting to buy alcohol? What charges and penalties could this person expect to face?

Unless they tried to use a fake ID or tried to steal the alcohol they have commited no crime that I'm aware of.... Unless being a complete idiot is a crime....

What will they be charged with? Attempted possesion of alcohol by a minor? I don't think so....

Yes. You've committed a crime -- attempt to purchase alcohol illegally. Anything that could be constituted as a crime that is stopped before it can take place is an "attempt" offense. Ex. attempted murder, attempted robbery, etc. I couldn't tell you the exact charges or anything like that because it depends on state law.

Of course, I have never seen/heard of anyone being charged with this.

Attempting to commit a crime, and commenting a crime are usually treated identically. I just got out of jail. Same offence, same charge, there's a little section at the top of your background check that says attempted/commited and there's either an "A" or a "C" beside it

I don't think so. Now if he fasified an ID to alter his age that would be a criminal charge. But just asking for some booze isn't a crime because the seller by law cannot sell it......"no harm in asking" right?

Attempting to commit a crime is itself a crime in all states, but how it is dealt with varies from state to state.

Well, the president's daughter was fined $600 and had to do 46 hours of community service. I'll bet your penalties would be more, but it varies by state.

Yes. Although being a minor the legal consequences will be small. Unless he was MY kid in which case ... well ... there would be consequences indeed!~
