do they have a right to assume illness? do they just assign you a punishment? suppose the defiance was repetitive out of pure resentment for the doctor. would the subject be considered ill and thence be treated?

Depends on the situation. If it is easily discernible that the defiance is out of resentment toward them, they would tell you to find someone else to see. I don't understand why someone would see a psychologist or psychiatrist that they don't like anyhow.

Unless the psychiatrist is a real bastard, he would simply tell you to find another psychiatrist. I am not sure how much power they have to commit someone against their will. My brother is mentally ill and we have taken him to psychiatrists. They agree he is mentally ill, but they refuse to put him on medication or hospitalize him unless he is clearly a danger to others or himself. So I don't think there is any need to worry that they will commit you against your will.

Most likely they'd tell you to go see another practitioner.
