A guy has the cell phone which was stolen from me, but he won't return it unless I pay him what he paid for the phone. The police department is closed right now, so I can't call them for help. If I set up a meeting with this guy to get my phone back, can I THEN legally call 911 to report a crime in progress (i.e. he is trying to 'sell' me my own stolen phone)? Or would I get in trouble for setting him up?

Well I don't think that it's 'closed', per se, but they won't answer a non-emergency call on weekends.

I can't believe you said the Police Station is closed.

If the guy has your stolen phone and you know he has it....

1: Disconnect the service.

2: Call and report him to the police as having stolen property. Are there any Patrolmen in your town? He is in possession of stolen property and like theft, receiving stolen property is a crime, too.

Once you appear at his door with the police, he'll forget all about how much he paid for the phone.

I don't know if you have to set up a meeting with him, but if you do, record the conversation and make sure that he admits that he knows the phone is stolen. Then he will get in trouble for being involved with the buying and selling of stolen property and you will be off the hook because you have proof. Go to an electronics store and pic up a small recording device.

I would not meet up with this person. For one thing, if he is asking for money for the phone then he is not afraid to do illegal actions. For your own safety, just stay away. Wait until tomorrow and file a report with the police. For now, just contact your cell phone provider and ask them to cancel the phone.

I agree with just a mom..
Your police dept is closed.. seriously..
Wherever you bought the phone, can you explain to them what has and is happening. can they shut it off without cost to you. Thus ending your need to get the phone back..
I can't get over that the police dept is closed.. good lord!

Care to give the FBI a call.. if this guy is trying to get you to buy back your phone..

tell your local police or state police be at thier place and then call the guy to set up a meeting place to get your phone back the police should arrest him there on the spot. or at least that what they did for a friend of mine

you live in a place where the police station closes? wow,i live in a small town of 4000 and our cop shop is always open.so this guy is probably the guy who stole your phone in the first place,dont try to set him up on your own,that could have a potentially dangerous outcome,or he could just be a slick willy type and turn it on ya,id wait until the cop shop opens and file a formal complaint,and then once the cops are clued in then try to get it back

call the cell phone company immediatly and report your phone stolen if you have the name of the guy give it to them and let them call the police. good luck getting it back

I'm sorry....but I'm still stumped about your police dept being closed. What, like they have hours of 9-5. No crime allowed after hours.. That is just wierd. Good luck with your situation.

Cancel your service... you're liable for any calls he may make !! Call the police in the morning... He's in possesion of stolen property, fencing, and low-grade extortion I think.

Then call your City government and as why the H-E-L-L their police has bankers hours !!

I just can't believe that.

He could get arrested for receiving stolen property. You wouldn't get in trouble for setting him up, but I wouldn't recommend you set him up, out of fear for your safety.

P.S.--The police department is CLOSED??? Where do you live?
