1. have you reset the connection between it and the transmitter? There will be a button to press [at the same time] on both.
2. Is the transmitter close enough to the mouse or is there a barrier between it and mouse?
3. have you tried start>settings>control panel>mouse.pointer options? maybe it is too fast/slow etc Have a play with those options.
4. If it is not these maybe you have a virus????
5. Or it is a dud?

Its possible that it is a driver problem or it could be hardware. A simple hardware check that may help is, take the the wireless mouse input, that is plugged it into usb and switch it to another port, and of course make sure this is in range of the mouse.
Now that may or may not solve issues, another thing that should be done is to reinstall or update your mouse drivers, or if you just pluged and played it in, and didnt install a driver cd, try that. If you did, then go to the manufactures website and lookup your mouse and get the latest drivers for it, install them, restart and see how it goes. Also try there support to see if this is a common problem..
If this doesnt work, more information on the make and model of your mouse may allow for better assistance.
Good luck though, hopefully its just a driver problem.

Turn the mouse upside down. You will see how to take off a little plate. It slides down and of. Under the plate, you will see a battery. Replace it because its worn out. When you put a new one in the correct way, the mouse will work again. Wha-laa!!

That sounds like a driver problem but it could be the receiver that freezes.
You could start by downloading the latest driver from your manufacturer's web site. If that doesn't solve it, you may have to test a different receiver to make a definite conclusion.

Got your receipt; a device that works and don't work is not too reliable. Bring it back and get a new one; or check you battery with a voltage tester to make sure it is well charged.
