Lips of an Angel is a very good song.
they must be cool people if he can play it. I would go upstairs and ask if the guitarist would let you sit in and listen and while your up the explain that you can always hear him playing and see if you can work out somesort of dont play at this time schedule.

we use to have very annoying neighbors that lived below me and there kids were brats that never shut up day or not. So I just ever so politly opened my front door and asked them to go somewhere else because my baby was sleeping.
Keep in mind I have no kids but after that they kept it down.
so maybe you could tell your upstairs neighbor that you are babysitting or that your baby is sleeping.. see how that works.

Give me the persons address and I'll bring my guitar over and I'll make him or her play some LOUD & Fast songs that are better than that crappy song!!!!

Talk to him about it....that it's keeping you from sleeping...etc. If you can't talk to him, then talk to your landlord about the situation and have HIM talk to the guy. If that's not an option, after about 11 or midnight, call the cops.
