we live in a apartment (we bought it ) on the bottom we have a little space outside that has a fence around it (u cant see anything from the outside) the association manager jumped throught the fence and took pictures of our balcony. Can he do that?

If he wasn't in a common area, you need to make it clear to him that he was trespassing and that you will file a complaint with the police the next time he tries something like that.

did you construct the fence? if you did then he might be getting pictures for a lawsuit. If it was already there then no, he shouldn't be jumping over. You should call him and see what he was doing and tell him that you don't want him to do that anymore because you consider it to be your personal space, if he needs to get in then you would be willing to let him in.

I doubt your local police would be much help, but tell the creep in no uncertain terms that if he does it again you will kick his butt
