In theory it is the president who appoints the the Supreme Court Justices but, he doesn't have the final say because who he submits as a nominee for that position must also be confirmed (approved) by the Congress.

It is a correct answer to say that the President does and the Congress approves it.

It is also a correct answer to say that the President Selects the nominee for appointment and that the Congress selects the Justice since they have the final say so in approving the nomination. If they say no, he submits another person for them to consider approving or not. If they say OK then that person becomes a Justice.

So while the correct answer for school is that Supreme Court Justices are appointed by the President, It can also be argued that it is actually the Congress who selects to approve or reject the person nominated (selected) by the President. So therefore since they (Congress) has the final approval it is therefore the Congress who selects the Justice.

What we are really talking about is "balance of power & checks and balances" that neither the congress nor the president have total control over who becomes a Justice.

But again, the answer yu are looking for if this is for School is that the President makes the appointment which must be confirmed by the Congress.

They are appointed by the current President, however, they then must pass through and get at least 50% of the Senate approval to get the Judgeship.
