Legally no. The ring is a promise, and by accepting it she promises too. If you split up before you are married, she is supposed to return the ring to you. However, if you get married, and later get a divorce, the ring is hers forever, if she wants it.

Legally no because it's kind of like a contract. You are given the ring with the promise of marriage. The ring should be returned if the engagement breaks up. On the other hand (no pun intended. She could always say it was a gift if she wanted to keep it. It could be fought easily.

No, engagement rings are given as a contract promising marriage, even when someone marries then separates, the engagement ring belongs to the giver of it as the contract will have been broken. However in the case of lesbians I am not quite sure, I guess it depends whether lesbian marriages are legal wherever you live.

well..are you still in a relationship?? if so..then fine...but just tell her that's the engagement ring...and she's not getting another prize for her to say no again to.
Personally I'd have proposed without the ring..then got a ring after the fact....but I'm not a traditional kinna guy

You don't give the ring until shes say "yes, I accept". If she says yes, changes her mind a few months later, you are entilted to get back the ring. However, if you're the one who has a mind change, then I think she is entitled to keep the ring.

If you propose and she says no then she has refused the ring. It never was hers to keep. It is only after accepting the proposal that the ring becomes her property, as a symbol of your commitment to marry and to each other.
