I had an oral agreement with my Landlord that my last month rent would be taken out of my deposit, when it came time to move,now she has gone back on her word, is this legal in the State of California?

I donut know about California rental laws however I would think that would be really hard to prove in a court of law.

You did not say whether you had a lease, if so the lease should spell out how the deposit will be used or dealt with at the end of the lease.

If it says that your deposit is just that a security deposit not to be used as last months rent then that is just what must happen.

The landlord can and probably will come after you and hold you liable to the terms of the lease.

An oral agreement is as good as the paper it is written on unless you have witnesses that are willing to go to court with you

An oral agreement is hard to prove because it is your word against your landlords.

Well, if you moved out and didn't pay the last months rent, whats the big deal? You just won't get your security deposit back....

Oral means nothing in a court of law. it has to be in writing period
