2) If they married as man & woman, instead of having a same sex marriage, then it's invali

I really don't know but what a rude surprise!
Did you really have no hint no idea what so ever not a single clue!
Are you in love with her, did she explain the issue to you.
Was she born with both genitalia so therefore really was female to begin with.
I am surprised that you had no idea, I would think that in this day and age you would have already had been intimate and had met family and such.
Good luck with this one because then again she is legally a female so I don't know that before she met you has any bearing on the legal aspect of a null and void marriage.

No some people are born with both sets of organs, some work some don't. so at birth they would use the most predominant one. but later if the other ones are the one working they can use corrective surgery to fix that. Or the hospital could have made a mistake on the paper work. to many variable to take into account.
