Yes, some Americans are capable of it, but I have to hand it to the administration and its staff - their use off buzzwords and slogans has worked brilliantly. It has turned many Americans into mindless parrots. The shorthand works for others who have trouble explaining difficult concepts. Notice you can't use these words to intelligently discuss something because they fail to take into account fine distinctions and shades of gray.

"Activist judges" is the worst because it discredits the legal system and is usually spoken by someone that couldn't read a court opinion without a legal dictionary and then a regular dictionar to figure out what the legal dictionary is saying. The courts have had the right to review the constitutionality of legislation for the past 200 years. Was Chief Justice Marshall and activist judge? What about the Warren Court that decided Brown v. Board of Ed.? Definitely an "activist" Court by today's standards. I'm thankful for judges that make meaningful, well reasoned decisions protecting our rights.

Activist judge is a purely American term. It comes from the Supreme Courts that decided to make law instead of just interpret it. It is an important term when discussing American politics because some of the most contentious issues, abortion and the separation of church and state, are court rulings, not laws.

There are many other court decisions that have becomes law, rather than just interpretations of the law.
