What you have paid up to now is all good but it has nothing to do with today other than you paid her what you two agreed upon prior. You need to find out what the minimum child support is where youre at (this is the amount you can expect to pay once its awarded in divorce court) because the amount you have been paying may be smaller than what you might get. So you may want to work out the amount before going into divorce court. You will have to pay something so take the lesser amount and work it out with her. Now the courts do not care how much youve paid or how you will continue to pay just as long as you make your monthly payments. This will be court ordered so you wont have a choice but to pay it and how you do it is going to be your problem or you may end up seeing some jail time and will still have to pay whats in arrearage. So you may want to get a second job or do whatever to avoid falling behind. You dont necessarily need a attorney as you know what you got to do and there is no guarantee that the atty can help you but will charge you regardless. she hasn't scammed you like you're saying. You just need to get your a s s up and help her with the expenses for the kids. Gorw up. That's something you won't be able to get out of jsut like taxes. Wherever you live or work- they will garnesh your wages. No lawyer will get you to no pay child suppport. The only way you can escape it is if she's on drugs and can't take care of the kids. Then- the county will send the kids to you and suspend the child support which is the same thing to me. it doens't matter what you've documented- that will haunt you till the kids a re 18. my kid is 3 and his dad owes me 7thousand on child support. He thinks that by being nice to me i will suspend it but- screw that when i've been broke or sick and couldn't go to work- the child support money i've gotten has helped me alot. Be a man and take care of your kids!

If you were already paying more than a 3rd of your income going to CSS may be a good thing. The courts are actually fair nowadays. I have a good relationship with my daughters mother but I still suggest that we go to CSS I was planning on giving her 300 month for our daughter she wanted 400. They end up figuring my payments should only be 200 but I still pony up the extra 100 to help her with other expenses.

man this is tuff at lest you have documentation you need to get to court you may find the judge to show some mercy on you and not require you to pay so much. also spend time with your kid as much as possible. not for any other reason but for your love for her no matter how much you and your x don't get along. you'll be rewarded by the child's love.ps is the wife a legal immigrant?

Contact an attorney in your town. Nearly all attornies will see you for a very small fee ($15.00 or so) if not at no charge. They will advise you and likely will be happy to work something out with you as far as payment goes. Most importantly though...can't stress this enough..GET AN ATTORNEY. From one who knows, believe me, the courts are not about justice, all about who gets there first and who has an attorney. Get a pro on your side man, please.

The court will appoint you a lawyer for about $150.00 and as long as you keep all of your receipts and document everything then they will not make you pay more. Just make sure you keep everything. They will let you pay payments to pay your lawyer.

If you are broke file for welfare. They will pay for a lawyer for you. File for a divorce now and get it done. You have been separated long enough to move on it now.....

If you have no court ordered child support then she cant do a damn thing! She can cry and threaten what ever but until the court orders it, then she is just stuck out.

Be realistic and kind to your children. You should pay a reasonable amount based on what you could reasonably be expected to earn.
Forget the water over the dam. Love your children.
