a friend of my sons handed him his truck keys and went and did some things, My son decided to drive the truck ( he doesnt have his liscense or permit) he preceded to wreck the car into a teachers car at the school parking lot. We have to go to the sheriffs office tomorrow night i was just wondering what his chances of getting charged with theft are, He just got off probabtion Friday also

My sons caseworker told me we probably dont need a attorney but i feel we do What do you guys feel?

he did 650.00 worth of damage which we are willing to pay for

Unfortunately, if the lender of the keys was doing so for the purpose of security only, then yes. If the lender new your son was w/o license, then the lending of the keys was reasonably not for the purpose of operating the vehicle or removing it from the property. Bottom line, your son did not have permission to move the vehicle off property. Yes, auto theft is a possibility.

He took the keys and therefore accepted the repsonsibility of driving the truck without a license. He is responsible. I would think twice about believing what your son told you. It doesn't sound right to me and he has already been in trouble with the law.

Sounds to me like your son did not learn his lesson the first time.

What are you going to do Mom, cover for him the rest of his life? You are not helping him at all by wanting him to get by with this. Your son knew better than to do what he did before he did it. He has a mind of his own and it obviously is not working to his benefit right now. I would think it would solely depend on what charges the man of the truck brought against him. That is what will stand up in court.

Get your son some help. Stop trying to make things easier for him.

I wouldn't worry about being charged with theft, as I am about being charged with driving without a permit, and damages to the vehicle. Hopefully he is a minor, and this is his first offense

YES, Unless the owner expressly gives permission to use the vehicle it's theft!
