the Judge has full discretion you don't need a loophole you need an argument ( can you convince the Judge that you have a valid reason - does your dad have a history of crime or drug abuse ; something that could endanger you by having a public connection ( see where this is going )

Generally, if all else is good both parents must sign an affidavit approving (if older than age of maturity [18] it doesn't matter, you can, but that's obviously not the case if you have a guardian at litem). If there is an issue with your father, and you are not and never will be in his custody, the judge could still grant a name change. You will need to present sufficient evidence that because of you last name you are legitimately having problems, e.g. mental, emotional, etc. If you want additional help I would find out, maybe with the help of your guardian, where a law/legal clinic is, or other low income legal service, and they may be able to help you further.

How old are you? Who currently has custody of you? Where has your father been?
All of these are important to the outcome of the court hearing. If you are old enough you can file something with the court to kinda become independant, almost like a parental divorce but you do not get majority status - talk to your probate judge or whatever judge this jurisdiciton falls in in your area.

Go to Social Services, if you are 15 or 16 you may be declared an adult and then you have the right to change your name legally.

Good question.
The truth is, since it is a major decision, if you have full custody, you can. If not, he needs to be asked, but you have the last word. If he is so against it, he has to take you to court to stop you

In California you can only change it if it has been more than two years without any contact whatsoever with the father.
