I recieved a harassment restraining order about 1 month ago, from my ex who is now 2.5 months pregnant with my child. She doesn't want me in her life and even has said she doesn't want child support. We argued alot, over small stuff and I said some mean things as well as she did. We didn't make it as a couple, but I want to show the courts that i'm responsible, and want desperately to be in my child's life, can the harassment order effect visitation and or partial custody of the infant, I realize a baby needs its mom and I just want for now to see my baby regularly(weekends) and enjoy being a father, then eventually gain joint custody. Is this request a realisitic one in the eyes of the court? My ex is fiercly independent and stubborn, I wish me and her could talk but we can't. Another question what would be good steps to take to show the courts I'm a sincere person, and just want to be a great father. I know of things I'm just looking for outsiide advise. Thanks,

Our arguments were over me wanting to go to the doctor wit her and questioning if I was infact the father, I know in my heart i am, I don't know why I asked we called each other names and she got furious and i tryed talking to her and followed her to her moms house and she filed a stalking restraining order, when I just wanted to talk, I should have been more patient but it is what it is now, I have to make the best of what happened.

I attended the hearing the judge said I wanted to just hang on to hear in my life, when Infact all I wanted to know was about the pregnancy, I had a few minutes to talk and it didn't matter, she won.

NEVER TOUCHED HER!It was for harassment(stalking) NOT domestic violence.

You need to get an attorney. A restraining order is serious business and it has a plethora of consequences, depending on what state you live in. You need to fight the order in court. Why didn't you attend the restraining order hearing? You could have, and could have won.

It's terrible what two people do to each other huh? I would let a little time go by first, let your ex calm now. Breaking a restraining order these days is a serious offense, so don't be thinking about that. If the Judge found good reason to have one effect, your stuck for now concerning seeing your baby when it's born. You will need to get an attorney to help you with visitation, or a group called "Dad's" might be able to also show you how to help yourself. Not trying to make you feel bad, but why in God's name were you accusing your wife of being unfaithful? Can you even imagine how hurtful that was? What exactly was your true purpose? I wish you all well.

They do not put out restraining orders just for name calling. You must have hit her and/or threatened her to have the judge issue it.
You need to give it a rest. Pressing the matter now is just going to get you into more trouble. Don't even think of approaching her. You want to show the court you are serious? Then go get some counseling for your anger.

I cant give you any legal advice but common sense would say that you must first and foremost keep to the restrictions of your restraining order. If you are not working ....get a job. Get your life in order and show that you can be a caring person (perhaps consider some voluntary work?). Good luck

My brother went through something like this. He went to the court and potisioned for partial custody. He was granted that after they did a dna test on the child. He now gets to see the baby every weekend and every other holiday. good luck

They cannot deny you your right to see your child UNLESS you were proven to be a hazard or dangerous to the child.

If not, I would take it to court. You would get your visitations, but along with that, would be mandatory child support. I know the child support is a lot less when you have joint custody (seeing him or her every weekend), if there's any at all.

Good luck.
