I paid off the lawyer, filed papers, this was in April 2006. TOday is 10/27/06 I had to do a publication to summons him to court he never showed now my lawyer says she just go the paper work back from the publication which ran in August. She said she gotta file a motion for default .My question is when the h e ll is my divorce goin to be finalized. How long does it take to file for a motion for default? Ive been dealin with this since April.

This may encourage you, I just got the paperwork from my divorce finalized, signed, sealed, approved, and delivered to me. Mine also started in April. The lawyers like to blame each other, but they take their time getting the required papers completed and mailed to the other lawyer. The court is in no hurry to process the paperwork. My divorce had been approved and entered into the court records two weeks before I got the paperwork telling me this. Keep calling your lawyer. Bug him constantly. Talk to his secretary - she will get more done for you than he will.

It depends on your state and how busy the court is. Your attorner have to request another court date with amotion for Default. Normally, it will be about a month or more before you can get a court date.
After that, you will cgo to court with yoru attorney, and it will be done the same day, assuming that he doesnlt show up this time, in which case, they would have t postpone it once more.

Depends on the state that you are residing in. I do know that the motion for default is the last step to divorce being finalized. Your Judgment should be following very soon. Hang in there!

depending on the state you live in and how aggressive your lawyer is I have seen divorce cases linger as long as a year before it even goes before the judge. how ever its your money that was spent on the lawyer of your choice ,so get on the phone and tighten that lawyer up. if you are not satisfied with her performance you can report it to the Bar association in your area or the area that she represents.

Basically it depends how busy is the judge who is in charge of your case and how busy is you lawyer who must try to advance it though the system.

Thank goodness you don't live in Maryland.The divorces here take two years.
