Does the files being uploaded at the torrent sites have copyrights by uploading it?

Whether a file has a copyright depends on whether the author sought a copyright. And besides, there are lots of copyrighted programs that are distributed by the authors via torrents-- torrents aren't necessarily wrong or illegal.

However, many programs are ripped and cracked before being distributed via torrents, which violates the terms of many commercial copyrights. So to answer your question in short: not all files are illegal, but some definitely are.
