To be an insect it can only have 6 legs, anything with 8 legs is considered arachnid not insect :)

The definition of insects, shows a requirement that they have 6 legs. There are bugs that are not spiders, that have 8 legs and are still in the Arachnid family. These include tics, mites, scorpions and harvestmen.
