Most states in the US already have this exception. Only when the partner is more than 3 years older than the minor it is statutory rape (nearly) all the time.

In some States it does. Many states have statutory rape laws that include a minimum number of years age difference, for example, Statutory rape is sexual intercourse between a person under the age of 18 years and a person over the age of 18 years where there is at least 3 years age difference between the persons.

No. 17 year olds are children and 19 year olds are adults. If you are 19 you shouldn't be interested in somebody who is still in high school in the first place. The 19 year old should be busy with their own lives in college or at work in the real world. A 17 year old should be doing the same thing but with high school aged people. Also at 17 you should be worrying about school not having sex. Get your life together and focus on yourself and your future instead of putting out for a 19 year old that can;t find somebody their own age to date.

In the state of Missouri, the younger partner has to be 16 or younger for it to be statutory rape except in situations where one party is legally mentally unfit to consent.

The age for statutory rape should be lowered to 16 and the penalty should be a misdemeanor for men under the age of 21....

it does. unless your in some crazy conservative state. and good god 17 year old girls are by no means innocnet. you people who think 17 year olds and 19 years olds are wrong. well your just off base with reality. Don't let the T.V. tell you what to think.
if you think i'm wrong, well i dare you to have a conversation about sex with a 17 year old inner city girl. she'll probably know more about the subject then you.

I would say yes but then they will say but what about 16yr olds and 18 yr olds. and so on down the line. However i think if a 17 yrs old can be charged as an adult when it comes to a crime then, 17year olds should be able to make the choice of who they sleep with on their own also.
