This is one of the new big scams out there. These companies buy up "old debt" for pennies on the dollar, and then they harass you to try to get you to pay. Even if you paid a "reduced payoff amount" to the first collection agency that might have had it, they still try to con you into getting more money from the debt. If you don't ever admit that you paid it off at a lower settlement amount, they have no claim against you, but if you slip up and say you took the lower payoff, they can still try to get your money. There was a news story here on Yahoo or MSN not too long ago on this problem. If you filed bankruptcy, they shouldn't have any claim to get your money, if that debt was included in the bankruptcy.

If there isn't a UCC-1 lien filed on the title from the creditor, it is an unsecured debt and technically they shouldn't be able to pick up the collateral. If there is a lien on the title, then you need to make arrangements for them to pick it up. If they call and you answer, ask them to mail you a copy of the UCC-1 lien filed and see where that goes. Usually they will stop at that point.

I filed as well and a few copanies still called to try and get money. Once I told them that I filed, they stopped. They are supposed to. If they are still calling, fax them or mail them the copy of your bankcruptcy, at least the part that has them listed and the front page. If they continue calling, tell your lawyer.

There are laws against harassment from bill collectors. Call your attorney back and ask him where to report this person.
