My Mother is the "person" involved. She passed away back in August with no estate (she lived with me, that is why I am receiving her mail).

It's against the law to open ANYONE else's mail!

If the dead person is your relative/family member and you are the heir, you are allowed to open it to reply, if it's a bill; if it's a personal letter, you can then advise the person writing that your family member is gone; if the item is not for your relative/family member as above, and you know the person is dead, you should write addressee deceased on the envelope and place it back in the mail. From personal experience, it helps to cover the name/address of the addressee (not the return address) on the envelope - the post office has a tendency to just re-deliver, otherwise, without 'seeing' the added info.

Tecnically yes...unless your the spouse or immidiate family or the executor of the estate....but when was the last time you heard someone arrested for opening mail.

It's a Federal offense to open anyone's mail other than your own or Occupant/Resident---dead or alive. You should return to sender.

Opening/tampering with anyone elses mail is a federal offense.

Its not if you have either power of attorney, executor of the estate or the legal next of kin. Otherwise yes it is illegal.
