A man was convicted of sexual assault in a fair hearing and sent to prison for 6 months. Now there is someone who is up in arms about the case broadcasting the names of the victims all over his blog. Is this legal? What paths are available to put pressure on him to stop? I have no problem with him throwing his opinion around, but naming names has to be wrong.

I'm not an attorney, but I do know this is an evolving area of the law. There was just national news about a person winning a $$$$ suit against a blogger.

If you want to know exactly what your rights may be, you should talk to an attorney. You may need to look around on the internet to find an internet savvy attorney. Try looking at your State's Bar Association website and find the name of attorneys that sit on the technology committee. This should give you a place to start.

GOOD LUCK.

The law relating to disclosure of the victim of a sexual offenses name varies from State to State. What state did the original offense occur in?

Ethically, it is probably wrong, but it is not illegal. Most journalists agree to not publish the names, but bloggers like this one may just be the impetus legislators need to pass the legislation making it illegal.
