Our 14 year old son has Acute Lymphoblastic Leukemia (Pro-B) and was DXed on 09-31-06. On 10-25-06 we got a letter from our apt. complex stating they will not renew our lease. We believe it is because of my sons illness and that is because they have no other reason. We have never once been late with our rent and also have no complaints against us! We asked and they said nothing more than we have the right not to renew without reason and that is what they chose to do. Any help?

not sure of michagan law but my parents have managed complexes before and on one occassion my dad was waiting on lease to end to get rid of what he called an undesireable tennant...so when lease ended he did not offer new lease...tennant wanted to know why and he really needed no reason why...so he didnt accept the rent when they came to pay and started eviction process on them....tennant went to court and put rent money into an escrow account so they couldnt be told they were not paying rent and that got them a loophole but my dad figured out loophole of his own and started raising rent each month by 100 and eventually they couldnt afford it and were forced out that way...sad story...but no law about raising rent without lease in georgia at the time....find site on rental and housing laws for your area or state....hope all goes well for you and your family...god bless you

Your friend is giving you bad advice. HIPAA does not apply to the landlord. (The technical term: he is not a covered entity.) The HIPAA privacy and security rule forbids certain unauthorized disclosures of protected health information (PHI) by covered entities. In short, health care providers and their subcontractors are covered entities. Your doctor cannot disclose PHI, but your landlord can certainly ask whatever he wants. It is illegal to discriminate in housing based on certain protected classes. If he asked if your boyfriend was black, that would not be illegal, but refusing to rent to you because your boyfriend was black would be illegal, and by asking the question, he gives you evidence for the basis of his decision not to rent to you. Again, your friend is giving you very bad advice. It is very common for people who work in a field to base their understanding of the law on rumor and myth. The law doesn't enter into this. He can ask, and you can choose not to answer. Now, let's talk about how to handle this as a mature adult. If you were moving out because of something he could fix, you should tell him. (That's why he's asking.) He's been a problem in the past, and even if he promised to do better in the future, you would still want to move, so there is no point getting into it with him. So, you could tell him to mind his own business. Or, you can be nice and give him an excuse. Tell him that you're moving to another area. Tell him that you want a bigger place. Tell him something that won't turn into an argument (like: you're a bad landlord) so that when your next landlord wants to call him as a reference, you can do so. Or, tell him to mind his business and make it into a pointless fight.

This is the last thing you need at the moment, I really dont know what your rights are. Its not like leukaemia is contagious but it maybe less of a stress if you find some where new, instead of trying to fight it. Good luck with your son, my daughter had AML so I know what your going through. If you have a social worker where your son is getting treatment they may help by speaking to the owners. Some people just dont care and im sorry you have to go through this.

I am not a lawyer, but I believe there is nothing that you can do. There is no new contract to sign so you have no right to stay there. It is very unfair what they are doing to you. They probably think if your son gets sick that you guy will have to put all your money towards that and will be unable to pay the rent. Sorry to hear about your son. That is very sad. I do not identify myself with a religion, but I will pray for him either way. Good luck.

unfortunately the apartment complex is completely within its' rights. i find it unnerving that if it were you that didn't want to renew, without having a valid reason, you'd be penalized somehow. However, you may call or go to your local Housing and Urban Development (HUD) office. They are a really great resource for available housing!!!

Sorry about your luck, but they are not legally obligated to rent to you. Your contract is up and the have decided not to renew it. Period. End of conversation.

call a lawyer and find out what your rights are as a tenent and explain your circumstances good luck and God bless with your son

they can rent to whomever they please. sounds like they have done nothing illegal so it's time for you to move on.
