I am currently getting a divorce with my wife. I bought her a vehicle 6 months ago and she has been making the payments every month. She doesnt have the credit to get the vehicle switched over into her name, but I dont want to pay for insurance on it anymore. I also want to turn in the NY state tags that way I dont get my lisense suspended if she doesnt have insurance on it or if she doesnt turn in the plates when they should. So my only options are to take the vehicle (I really dont need the vehicle or the payments, Tell her to keep the vehicle and get insurance and register it in her name (is that possible to do with the vehicle loan in my name?). Selling the vehicle isnt an option because I went in the hole a little bit when I bought it, so I wouldnt get what I owe out of the sale. What are your thoughts?

I suggest very strongly that you speak with your lawyer on this matter, as the laws may very from place to place!

Make sure the divorce papers state that is gets the vehicle only if she makes the payments, insurance and that the license plate also be in her name if possible. Make sure it also states that if she does not make the payments and insurance that it goes back to you so you can do with it what you have to. Good luck I hope things work out for you.

Get her to, agree to switch every thing over, to some one in her family that has good credit.
And make copies of a transactions.
Make her do this a soon as possible, and make sure that all party are notified. If not, advise her that the car will have to be put up for sale.

Note if you don't do this, the new boy Friend will be driving your car.

Let her keep it as long as she pays for the insurance! Let that be understood! You could get her to take over the payments if she is working.

You can get it specified in the divorce papers that she's responsible for the car payments.
