I have an independent contractor who has not filed for taxes in 6 years. How will the court determine what he makes and owes for child support?

The court will set an amount to be paid regardless. Be ready shortly thereafter for the IRS to contact you for not filing tax returns.

The wages are either imputed against the person by the courts or the person seeking support has to prove income. You prove income by looking at life style or reviewing bank account statements. If 1099's are issued they will pay based on teh net amount: gross less business expenses. However a judge may rule expenses as excessive and charge them back as income.

The court will not care what he currently makes. The child support had already set an amount for monthly support they will wan that amount.

well, when it gets taken to court, they will then find out he hasnt paid taxes in 6 years and he will be in a world of hurt.
