If it is being done through Yahoo's Mail system then it's a TOS violation. Go to the Yahoo Mail Help page and choose the correct category of violation. Follow the links.

look for contact at the bottom of the page, customercare@yahoo.com and click on the abuse section and read what it says. Then report them and cite incidents that can be checked.

clck report abuse and type somthing in the little box that apears about it and they will do somthing about it. if they use this.
