The appropriate thing is to report the accident to your insurance company. If you were both backing, but you saw her and attempted to avoid the accident, you may be less negligent than the other driver.

What part of her car hit what part of your car? If the damages indicate that you were further out of your space than she was, this may also work in your favor.

It sounds like the other driver isn't interested in resolving this in an amicable manner. Unless you want to pay her deductible for her, report this to your insurance company and let them fight it out. Oh... and enroll your daughter in another pre-school.

Well I would not pay her a dime.
It is clear to see she was at fault. If you both were moving there would be damage to both cars. Since you had stoped and she hit she had the dammage.
It is like you dun into an object that does not move or is standing still. it shows up by the damage on the thing that was moving.
In this case she was at fault. Let her prove it was not her fault buy showing the damage to your car.

I gasped when I saw the "red teeth marks" part of your question. That teacher ABSOLUTELY should have told you that your child had been bitten. I think it's shocking that she failed to mention a bite. We CALL the parents if such an incident happens. Also, at my school, we are not allowed to say who is hitting, biting, kicking, throwing sand - whatever - but the child usually tells their parent anyway. Biting is not unusual - but it cannot be tolerated and it's DANGEROUS. Sometimes there is blood involved. (Ever hear of AIDS???) At my school we are required to fill out a report of a biting incident. Also - the "biters" parents have to be notified. After a child has bitten twice, they are required to go home for the remainder of the day. (this gets the parents to understand that biting is very serious and they need to make their child understand it's not okay) After the third incident of biting, the child can no longer attend our school. Very strict rules - and as they should be - i think. Perhaps your daughters' school has very different rules than the school where I teach - but I believe that based on the teacher's reaction to the bite and behavior (minimal reaction). Your next step is to go to the principal. Check in with the teacher one last time and clarify what requirements are when biting happens and what the next steps are in handling it. If what she says does not satisfy you - call the principal. Good luck.

Tell her that seeing as she backed into a stopped vehicle, she is the one at fault. If she continues to insist you pay, tell her that you will be happy to have a judge decide the case. Also tell her that if she wants to go that route, you will be filing a counter suit for emotional distress..

Find a new preschool and tell her to whistle for the money. She wasn't looking where she was going, it's her fault. You are only supposed to back up when it is safe to do so. Obviously it was not safe.

some parking lots have a no fault rule, best to let her go to court and let the judge deside. :)

Either nobody knew what was going on, didn't understand what was going on, or somebody doesn't want to admit what happened.
