Leave the man/woman alone. I'm a smoker too and I do smoke in my car, but I don't have any kids. No, it's not illegal to smoke in your car in New York. If you keep the window down and the cigarette outside of the car, the smoke doesn't even come into the car. Get a grip people, smokers have rights too.
