I was working overnights at a gas station. And i was robbed at gunpoint. He never attacked me or anything. But now i had to quit my job because i was afraid to work there. And now i get scared when i'm working anywhere that deals with handling cash. Can i sue the company? And would i need a lawyer?

You can't really sue the company unless their system was so lax that there was no protection for you.

I would suggest talking to a counselor, and possibly pursuing disability.

You can sue anyone, any time. It's a matter of whether you'll win or not. In your case, you have a chance of winning, but not a strong one. Your case is primarily a workers comp case. When a case falls under their jurisdiction, employers become only secondarily liable. To prevail, you would need to show that your employer was guilty of gross negligence in dealing with the issue. You would have to show that the employer knew about the issue (who wouldn't,) that you were injured (sounds like it to me,) and that they did nothing to combat the issue. Obviously the last test is the tough one. Did they post signs, did they employ a security guard, did they provide supervision to the station during all hours, did they suggest therapy for you; the list would go on and on.

Besides all of that, it sounds like you have a bonafide workers comp case (state industrial, etc.) Go to your former employer's business office and complete a form and then make yourself an appointment with a qualified counselor. You should be able to receive payment for lost work, treatment, and maybe disability compensation. Good luck.

Generally speaking, a company (or anyone else for that matter) is not responsible for the actions of another. In your case, the company cannot be held responsible for the actions of the criminal that robbed you. In addition, you should have known that working at a gas station overnight carried with it a risk of being robbed, and you readily accepted that risk until it happened.

You should seek the advice of a lawyer in your area.

Dude, no offense, but don't be retarded. Being robbed is a part of working at a gas station, my wife was about robbed a few times. I've been robbed at gunpoint delivering pizzas. get over your fears and move on with your life. Suing someone over something beyond their control is just plain retarded. grow up man.

I was robbed & shot while working.I was told that I couldnt sue my employer in NY.But,,why would I want to,,its not their fault.You can however sue the person that robbed you if you were injured.Laws vary state to state.

Yeah, go for it. Pretty soon not only will kids not be able to play at recess, but all service stations will have to close before dusk so no one gets sued. Why not?

You could try filing workman's comp, but it may be too late for that.

I doubt that would fly, but you may be able to look into disability.
