This is basically a question for a friend. He opened a cell phone store. So what do you think might happen if he did sign an agreement?what should he do?

Yes he did sign a contract and I think they found out.

Check to see if you signed any employment agreement when you started working there. If it has a "non-compete clause", then you may be prohibited from working for another company. If you did not sign anything upon employment, you should be OK. Good luck.

This depends on how high up you were.
A regular cashier/ customer service representative can change companies at will.
If you were a branch or store manager a month or two is all they hold you back at most.
A regional manager would be high enough up that you would know a few trade secrets so they could prevent you from going to a competitor.

If you were an executive's secretary you could also be held back a while.

Regardless they cannot stop you from the right to earn a living. Unless there is a severance package and contract that prevents this from happening.

If that's what your contract says, yes. Most cell phone contracts are now actually 2 years. If you break the contract, you'll pay a fee as spelled out in your contract. So, read your contract. It's all spelled out right there.

Yep, agree with the others did you sign a non-compete?

And if you did it will probably prohibit you from working for another company for a year AFTER you leave your present employer, not while still employed there.

If you are cashing your paychecks you are agreeing to their terms of employment.

depends on if you signed a form called a non compete that will tell you. If you did not sign a form then no.
