I spit it out right before I would have swallowed it. My first time tasting this kind of sub. it sucks, and then there is a bone in it. I got it to go, so I discovered it at home. the bone is about 1 inch in length.

Well, now that you have come on the Web and told the world, I would be careful. Since you can't prove anything that they did. But they can now Prove that you are on here writing things about them that are libel.

Besides, are you hurt or injured in any way, what harm has been done to you?

Get a life... you are eating fast-food... perhaps your expectations are too high. And sue for what? Were you hurt or are you just pissed off. You are a product of a society that wants everything sugar-coated and gift-wrapped and no responsibility. Chicken have bones because they are little animals.... If you really want to make a difference, leave your bruised ego home, go back to the store and speak quietly with the manager... I know this may sound harsh to you, but you come across as a whiner and when you post crap like: "condoms, lube, cucumbers, bananas. great time to teach them about safe sex. after they got it down practicing on the bananas, email me, I'll be over there shortly. haaaaaaaahaaaaa." as an answer to someone's request for ideas for 13-year old girls slumber party, you need a little kick in the ***. If you save the rest of the food you can call health department and explain your situation. They may want you to turn in the teriyaki chicken for further investigation. You may also want to contact the restaurant and informed them that their food have chicken bones which cause you to also choked. In terms of sueing them, It's not that easy unless you have hard evidence. You bringing the food home doesn't really help your arguement. They may say that you put the bone in your food on purpose. I have restaurants, and customer complaints that they chocked on chicken bone before as well. The funny thing is that Egg Rolls customer order from us is pure vegetable. How can there be any chicken bone? It was obvious the guy was lying. He did called health department on me but health department couldn't do much. I prove it to them that my Egg rolls are pure vegetable.... buttom line is it's not that easy to sue a restaurant. You maybe wasting time and enery. You may consider contacting the place to get a refund for the money you spent.

If you found a rat in your sandwich, yes. If you found a finger, yes. But a bone? No. You can't sue. And besides, who do you think will have the better lawyers? You or a multi-million dollar company?
You'll be lucky if you get a free sub.

The laws may vary by state for this, but I believe you can not sue if it is a food by-product. I.E.) You can't sue for a chicken bone, because it is technically part of the chicken, even though everyone knows you can't eat them and it could be dangerous. However, if it was a piece of. . .say. . . .metal. . .then you could sue because that has nothing to do with your food. . .And either way, you'd have to be hurt or injured in someway by eating whatever it was.

There'a always a risk of finding a bone in any kind of chicken you eat, and I don't think you can - or should - sue just because you "almost" choked. You didn't, so no harm was done and next time you'll be more careful. Unless it was advertised as boneless, I doubt if you'd have much of a case.

I would return to the subway explain to the manager. They will probably refund your money and give you a new sub of your choice. Sueing for something like this (no injury) occurred makes the lawyers rich and will forever make people wary of you.
