The person responsible for the credit cards is whom ever is on the account and if it is her regarldess of the last name, she is responsible for the debt not you.
You speak of under her name under your name....blah blah blah
That is no significance what so ever. If she had taken out a credit card with her own credit and put your name on it..she takes the dive and beoing married will not change that unless you take a card out and have an extra crad made for your spouse and then you are responsible for the debt not your wife.

It might depend, but if the debt was before the marriage it shouldnt be community property. When people get divorce it can be very contested which costs them more money in legal fees. Some people choose to negotiate to make things easier. You could fight the issue in court, or have it put in the divorce decree that she pays or assumes all of her debt

Depending on how the divorce papers are drawn.
You can stipulate that she should pay her own bills and be responsible for them. If she agrees to this, then there will be no problem, but she might contest it and say that those where incurredduring the marriage, in which case, would be considered marital debt, which would be split in between the two of you.

Only if she puts it in the divorce papers of wanting to split the debt between you two. She could say that these were expenses that occured throughout the duration of the marriage.

any debt she had befor your marriage isnt your responsibility.....but any debt put on the accounts after your marriage is half yours (example: she owes 5000 on a credit card befor your marriage, then charges 5000 more after, you are responsible for half the additional 5000)......it works the same way with assets if you have 20000 in equity in your home, you marry, she is entitled to half of any equity above the 20000 that is built during marriage.

Tear up the cards and tell her to pay up! If you get a divorce then you may have to pay half of it or all of it!

just suck it up and help her pay it off quickly....it will probably relieve some tension! then you will be debt free, so if you get divorced...there will be nothing to pay off. Just make sure she doesn't rack up more debt!!
