We are moving and have to leave before our old house is sold, we will give our realtor full "rights" to sell this house without us being around. But until it is sold we have a family with 3 kids wanting to rent the house till it is sold. Should we do this especially since we can't be here to check if they clean it up before prospective buyers come around to look at it? We are quite torn over this....

We know the family that want to rent the house, they are waiting for the papers to go through on the house they are buying, and need somewhere to stay in the mean time as their rent-contract on their current house is up and they don't want to re-new since they are buying the new house.

They also know the deal that if the house is bought quickly they HAVE to get out. But they think their new house will be cleared to move into within few months time.

Hard to judge character. I agree w/ a pp. I have seen several adults that don't know how to clean... I have 2 kids & keep a very clean home. A few crayon marks here & there.. but kids will be kids.
I probably would rent to the family if I was reasonably sure that my home wouldn't be damaged. You could always take a nice large deposit & make a list of the homes current flaws.. and after they move out make them pay for any new flaws out of the deposit.

With kids I'd say no. It'd be too hard on them and it depends on how far away they're moving from.
I've been through 7 moves myself, and 3 of them included changing schools. It wasn't easy, and if the kids that would move in should they rent your sale-pending house would probably go through something similar. If they're moving from the same town or will be going to the same school when they leave the house you have to move out of then it shouldn't matter, but if they have to change schools don't do it.
It'll also depend on how long they'll be there, or how long that house itself will be sale-pending on the market. You'll have other people coming to look at the house and the family will be in charge of cleaning it, not you since they'll be there while you're not. If you all of a sudden say "Oh, this house just got permanently bought" and you just give them a deadline to be out by it'll be havoc on them. And then if they decide to move out you'll be stuck with 2 houses.
I'd say don't do it, it'll really complicate things for a lot of people and hopefully you have money saved up to pay for the expenses of both houses.

Just because they have children does not mean they will not take care of the place. I have seen messier adults than kids - if you are still in the area go by the place they live at now and see how yard and such is kept up and that will give you a clue as to how they will treat your place. Talk with the people - they might end up being excellent renters!

Tough one. The income would be great, but the house may not sell as quickly. I'd say the money isn't worth the risk. More could happen than just the house looking bad. They could tear it up, try to refuse to move in a timely manner, etc. I'd say forget the rental.

Don't do it. when looking at houses, a lot of renters didn't clean up ( i just recently bought a house that was rented) and then when you do sell it you have to worry about them getting out in time and leaving it clean. Paula had a good point too, if you do decide to rent it, you can't NOT rent to someone just because they have kids, its highly illegal. You want my opinion, don't rent it.

Check with your Realtor. S/he will be able to advise you how to avoid breaking Fair Housing Laws such as discrimination based on familial status.
Straight from the Fair Housing Law website...
Housing Opportunities for Families
Unless a building or community qualifies as housing for older persons, it may not discriminate based on familial status. That is, it may not discriminate against families in which one or more children under 18 live with:
* A parent
* A person who has legal custody of the child or children or
* The designee of the parent or legal custodian, with the parent or custodian's written permission.
Familial status protection also applies to pregnant women and anyone securing legal custody of a child under 18. Exemption: Housing for older persons is exempt from the prohibition against familial status discrimination if:
* The HUD Secretary has determined that it is specifically designed for and occupied by elderly persons under a Federal, State or local government program or
* It is occupied solely by persons who are 62 or older or
* It houses at least one person who is 55 or older in at least 80 percent of the occupied units, and adheres to a policy that demonstrates an intent to house persons who are 55 or older.
A transition period permits residents on or before September 13, 1988, to continue living in the housing, regardless of their age, without interfering with the exemption.

What if they damage your house? It doesn't seem worth the risk for a few months rent money. Also I have to wonder why they would even want to rent a house that is up for sale. Moving is costly and time consuming so why would they even want to put themselves in the position of having to move again a few months after they move in. Sounds kinda fishy to me.

no it is not worth the trouble if the house is on the market it could make it less appealing if the buyer has to wait for move out and clean up . . .
