The US is in no way obligated to sign an "International Court" treaty. The international court has appointed judges that have no checks and balances or oversight. It was pretty foolish for anyone to sign it.
The UN authorized the use of force in Iraq with Resolution 1441, so no it cannot be liable for criminal activity.
Can we force Europe to sign a treaty they don't like? If you are forced to sign a treat your sovereignty is threatened.

The Sovereignty of the US? No, we cannot be held liable, and on the same tokken, be held liable by whom, the United Nations? What would they do, place sanctions against us? Who would sanction the most powerful nation on earth?

No, UN Resolution 1441 approved it. As well as the cease fire treaty signed by Saddam to end the first Gulf War.

Internationally speaking, engaging in war is not considered criminal activity. The conduct of war is regulated by the "laws of war." For the most part, these are the Hague Conventions and the Geneva Conventions.
Violations of the laws of war are considered "war crimes." But the act of engaging in war itself is not a war crime.

The US does not recognize the right of any court or body to be able to judge our actions, nor have they any right over judgement of our military.
This is an inviolable aspect of sovereignty that no sane country would freely part with.
